Terms of Service

1. Acceptance of Terms

By accessing or using the CR38TED platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. CR38TED reserves the right to update these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

CR38TED is a platform that connects artists and creators with event opportunities, including but not limited to creator markets, art shows, and vendor events. The Service allows artists to create profiles, showcase their work, and apply for participation in events organized through the platform.

3. User Accounts

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your password and account
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

4. Artist Responsibilities

As an artist using the CR38TED platform, you agree to:

  • Only upload content that you own or have the right to use
  • Provide accurate descriptions of your work and booth
  • Honor commitments made when accepted to events
  • Comply with all event-specific rules and requirements
  • Maintain professional conduct at all events
  • Not engage in any fraudulent or deceptive practices

5. Event Applications

Submitting an application to an event does not guarantee acceptance. Event organizers have sole discretion over which artists are accepted. Application fees, if any, are non-refundable unless otherwise specified. Once accepted to an event, cancellations may be subject to penalties as outlined in the specific event terms.

6. Fees and Taxes

Vendors participating in CR38TED events are responsible for:

  • All applicable taxes, insurance, and health permits required for their business operations
  • All city, county, and state taxes related to sales and business activities conducted at events
  • Maintaining proper business records and tax documentation

CR38TED is not liable for any vendor tax obligations or penalties arising from vendor noncompliance with tax laws.

7. Licensing and Regulations

Vendors must comply with all applicable laws and regulations:

  • Comply with all city, county, state, and federal laws while participating in events
  • Provide all required licenses, permits, inspections, and certificates along with their application
  • Maintain valid and current documentation throughout the duration of any event participation
  • Immediately notify CR38TED of any changes to licensing or permit status

CR38TED is not liable for vendor noncompliance with any licensing or regulatory requirements.

8. Insurance Requirements

Vendors must meet the following insurance requirements:

  • All food and beverage vendors must provide proof of $1,000,000 commercial general liability insurance
  • Vendors must submit a liability waiver indemnifying CR38TED, its board, volunteers, employees, and the host property
  • Vendors must name CR38TED as additional insured on their liability policy
  • Proof of insurance must be submitted prior to event participation and remain valid throughout the event

9. Intellectual Property

You retain all ownership rights to the content you upload to CR38TED. By uploading content, you grant CR38TED a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content solely for the purpose of operating and promoting the Service and related events. This license ends when you delete your content or account.

10. Prohibited Conduct

You agree not to:

  • Use the Service for any illegal purpose
  • Upload content that infringes on others' intellectual property rights
  • Harass, abuse, or harm other users
  • Attempt to gain unauthorized access to the Service
  • Use automated systems to access the Service without permission
  • Interfere with the proper functioning of the Service

11. Limitation of Liability

To the maximum extent permitted by law, CR38TED shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability shall not exceed the amount you paid to us in the twelve months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless CR38TED, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

13. Termination

We may terminate or suspend your account at any time for any reason, including violation of these Terms. Upon termination, your right to use the Service will immediately cease. You may also delete your account at any time through your account settings.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Denver, Colorado.
